GDPR Archiving

The details of Bailys Hunt Data is only available to verified legitimate subscribers.

Hunt data information is covered under the GDPR  derogation ‘Archiving in the public interest’. Under this provision, data  is processed to secure the permanent availability of recorded memory, in other words, evidence and information, for a wide range of current and potential future purposes, including:

      • enabling research and investigation of all kinds, from academic historical research, genealogical research or political comment
      • enabling the discovery and availability of personal, community and corporate identity, memory and history
      • enabling the establishment and maintenance of rights and obligations and of precedent decisions
      • enabling educational use
However, we may consider requests to have personal data removed from public view on ethical grounds under takedown policies if data subjects have expressed their concern and the wider balance with freedom of expression and information is not significantly affected.

Baily’s data may be used as a matter of record in both judicial and political environments.

Striking a Balance

The UK safeguards are currently contained in section 19 of the Data Protection Act 2018. Under the data protection law individuals may have the right to have personal data erased. The right is not absolute and does not apply under the archiving principle. However, we take the rights of individuals listed with hunt data seriously and have built in the ability for  safeguards to protect rights of the subject who can demonstrate that holding their data during their period of office  is ‘likely to cause substantial damage or substantial distress to a data subject’

In order to allow such data subjects to be protected, we have a range of privacy settings to prevent data subjects from being identified by subscribers.
What constitutes serious damage or distress?

The Act does not define what is meant by serious damage or distress. However, in most cases:

  • substantial damage would be financial loss or physical harm; and
  • substantial distress would be a level of upset, or emotional or mental pain, that goes beyond annoyance or irritation, strong dislike, or a feeling that the processing is morally abhorrent
